ANDREW BAKER
Andrew joins SW Legal as a consultant, bringing specialist expertise in financial services regulation, regulatory defence, and financial crime. His dual perspective — as both a former senior regulator and a practising advocate — makes him a distinctive resource for businesses navigating the increasingly complex regulatory environment of the Isle of Man and beyond.
Andrew spent a number of years as a senior enforcement officer at the Isle of Man Financial Services Authority, where he acted as the Authority’s primary representative on insolvency matters and led public interest winding-up cases. During that time he oversaw a comprehensive reform of the Enforcement division’s policies, procedures, and decision-making frameworks, including a full redesign of the director disqualification regime.
His caseload spanned the full breadth of regulatory enforcement: contraventions of the AML Code and Regulatory Rulebook, breaches of the Financial Services Act, Insurance Act, Retirement Benefits Schemes Act, and Collective Investment Schemes legislation, as well as CODA proceedings. He worked closely with the economic crime unit, PIMLIT, the Financial Intelligence Unit, and the Gambling Supervision Commission, and engaged regularly with international counterparts including the FCA, the Jersey Financial Services Commission, and the Serious Fraud Office. Andrew also developed and delivered training to FSA staff on statutory powers and their application in inspections and enforcement actions, contributed to the Isle of Man’s National Risk Assessment and MoneyVal preparation, and co-led the AI Centre of Excellence — a cross-divisional workgroup examining the impact of artificial intelligence on financial services and regulation.
Before joining the FSA, Andrew practised as an advocate on the Isle of Man, building a strong litigation background across the courts, initially in criminal defence before moving into commercial litigation. He returns to private practice and consultancy with that litigation foundation reinforced by his regulatory experience, and now advises businesses, directors, and regulated entities on regulatory risk, compliance matters, enforcement response, and related disputes.
Andrew has gained an array of relevant qualifications including as a Trust and Estate Practitioner, a Certified Anti-Money Laundering Specialist, and a Certified GDPR Practitioner. He holds further qualifications in Investment Compliance, International Regulation, and Financial Investigations.
